In December 2025, comments attributed to Elon Musk suggested that FSD v14.2.1 could tolerate brief phone interactions depending on surrounding traffic. The report concerned driver-monitoring behaviour in particular conditions; it did not establish legal permission to text, an approved eyes-off mode or an autonomous vehicle.

The discussion drew attention because earlier monitoring could warn about relatively brief glances away from the road. A different warning threshold, however, did not change the driver’s responsibility to remain attentive.

What the reported change meant

The original article described some situations in which a driver might look away without immediately receiving a warning or penalty. It compared this with Level 3 operation, but that comparison was misleading: a monitoring system’s tolerance of a glance does not determine the automation level. FSD Supervised still required active supervision and readiness to intervene; it had not become a certified eyes-off system.

FSD v14.2.1

The comparison with Level 3 systems

The article contrasted Tesla with Mercedes-Benz Drive Pilot, a separately approved Level 3 system available only within defined operational conditions. Its examples included certain Californian motorway use below 40 mph and limits concerning traffic, weather and road conditions. Those were system- and jurisdiction-specific conditions, not general permission to use a phone in any assisted-driving vehicle. Liability also depended on the applicable law and circumstances, rather than automatically transferring in every case.

The Tesla report did not establish:

  • Level 3 certification.
  • Regulatory approval for eyes-off driving.
  • A blanket transfer of responsibility away from the driver.
  • A reliable indication that the driver could stop supervising the road.

The practical concern was that reduced warnings could encourage distraction while the system still depended on an attentive driver. An absence of warnings was not evidence that looking away was safe.

Reported attention icons

The article also described an analysis of Tesla software assets showing low-, medium- and high-priority attention icons. These were not said to be visible in the released FSD interface at the time. Their presence suggested possible development work, not confirmation of a feature, its meaning or a future release date.

Traffic law still applies

Driver-monitoring behaviour while stationary had also been discussed. Rules on handheld-phone use differ by jurisdiction and may still apply when a car is stopped in traffic. Software allowing an interaction does not establish that it is lawful; the article did not verify a universal rule covering every location.

Keeping supervision central

The distinction matters even when assistance becomes more capable. The original report’s comparison of unsupervised FSD with human safety was not supported by comparable evidence presented here. Multiple camera views and advanced processing do not remove the need to watch the road and respond immediately.

Keep your attention on driving and follow the vehicle’s supervision instructions. If you need to use your phone, stop safely in a lawful place; do not treat a lack of warnings as permission to send even a brief message while moving.
